User Agreement

AGREEMENT BETWEEN YOU AND ALASKAWRITER LLC
AlaskaWriters Homestead, housed on http://www.alaskawriters.com and http://www.alaskawritershomestead.com, and operated by AlaskaWriter LLC, is a value-added service to allow AlaskaWriter LLC consulting/coaching clients to enable the creation and promotion of do-it-yourself Web sites for Alaska writers through the use of an online interface ("Alaska Web Writer") and related services.
This User Agreement constitutes a legal agreement between you and AlaskaWriter LLC. You must accept without modification all of the terms, conditions, and notices contained in this User Agreement in order to access and use AlaskaWriters Homestead Services. Use of your AlaskaWriters Homestead account or participation in any service offered on or via this site, indicates your acceptance of this User Agreement.

ALASKAWRITERS HOMESTEAD WEB SITES
AlaskaWriters Homestead sites will be located on a subdomain of alaskawriters.com to be assigned, as requested by the registered user. Assignments of subdomain names is on a first-come, first-served basis.
By ordering an AlaskaWriters Homestead membership using the online order form or a paper order form, or by phone, you agree to pay a nonrefundable set-up fee plus a subscription payment for an agreed-upon term (ie., 1 year). You may additionally choose other services.
Basic services will include the following:
- An initial consultation by phone, including advice on organization of your content.
- A user name and password that you can use to access your chosen editable Web site package.
- Online help text documents and information on how to use the service (at http://www.alaskawriters.com/help).
- E-mail-based technical support.
- An AlaskaWriters e-mail forwarding address to be directed to another e-mail account of your choice.
- Use of your chosen template package, which will be made available to you at a subdomain address.
- Hosting on Alaskawriters.com.
- Any additional services AlaskaWriter LLC may choose to include as part of a special promotion or offer at that time.
After your subscription term is up, you will have the opportunity to renew your subscription. Subscriptions not renewed within 90 days of expiration may result in a deleted site.
AlaskaWriters Homestead will make every effort to reduce necessary downtime in cases of server malfunction or other technical problems and to regularly back up member Web sites. However, the use of this or other online services on AlaskaWriters Homestead comes with no guarantees or warranties, and refunds cannot be offered in the unlikely event that data is irretrievably lost.
Under this User Agreement, it is your responsibility to keep your AlaskaWriters Homestead/Alaska Web Writer-related account information under your personal control at all times. You are responsible for all activities that occur in your account and you agree to notify AlaskaWriter LLC immediately of any unauthorized use of your account. AlaskaWriter LLC is not responsible for any loss that you may incur as a result of any unauthorized person using your account or your password.
Whether or not you receive assistance from an AlaskaWriters Homestead representative, you are solely responsible for any and all materials posted on your site and are solely legally responsible for any breaches of copyright or other laws therein.
If your membership lapses, you may not take, use or borrow for "reposting" or republication anywhere, any of the html code or graphic representations on your site provided as a part of your AlaskaWriters Homestead membership, including the AlaskaWriters LLC site templates. All you own is the intellectual property to any text and photos you input. If you move your site and want to continue using Alaska WebWriter, you must pay an additional fee for use of AlaskaWriters Homestead template and a license fee to install the Web Writer software on your new host site.
Accounts are not transferable.
Data sizes of standard account packages are limited to 20 MB, except by prior arrangement.

LIMITED LIABILITY
Final responsibility for assessing the suitability of and successfully implementing any advice, tips or other information gleaned from AlaskaWriters Homestead or AlaskaWriter LLC rests solely with Client. ALASKAWRITER LLC will not be held liable for damages arising from governmental or civil actions against the client resulting from the use or perceived use of any advice, consulting, coaching or tips posted on the site. AlaskaWriter LLC'S liability in any case is limited to the total amount paid by Client to AlaskaWriter LLC.

PRIVACY POLICY
AlaskaWriters Homestead (Service Mark), at http://www.alaskawriters.com, is owned and maintained by AlaskaWriter LLC, a single-member limited liability company registered in the State of Alaska.
AlaskaWriters Homestead's Internet privacy policy is as follows:
AlaskaWriter LLC values your privacy. This site will collect, retain or distribute personally identifiable information (name, e-mail address, etc.) only in the following instances:
-Personally identifying information you provide to the site or AlaskaWriter LLC will be used only in connection with services or to provide you with further information about the site or AlaskaWriter LLC's services.
-If you sign up for an e-mail newsletter, AlaskaWriter LLC will use the information you provide in order to deliver your newsletter and contact you in connection to services you may be interested in.
-Likewise, if you express interest in services, AlaskaWriter LLC may retain your personal contact information to notify you of services and special offers. You may unsubscribe from AlaskaWriter LLC's e-mail mailing list(s) at any time, using the instructions provided in every communication (or by e-mailing your request to editor@alaskawriters.com).
-E-mail addresses and other information provided in confidence to AlaskaWriter LLC will not be provided, sold or loaned to third parties for any other marketing service.

However, users should be aware of the following:
• All information you enter on your member Web sites via Alaska Web Writer is immediately available to the public from the time it is entered. You alone are responsible for all content on your Alaskawriters Homestead member site. If you have any concerns about revealing your personal address, phone number, e-mail, or other personal information on the World Wide Web, do not provide such information on your Web site. We will make every reasonable attempt to keep your password confidential (and you should do the same). To ensure confidentiality when using AlaskaWriter LLC's online services in a public place, be sure to "log out" when done.
• Tips, testimonials, news items, photos and other materials submitted for publication on any AlaskaWriter LLC site are assumed not to be delivered in confidence. If you do not wish your name or other identifying information to be posted on the Web, do not submit such materials.
• The site does require cookies for the effective use of certain services (such as Alaska Web Writer, the software used to make member Web sites) and also does collect statistics about how visitors in general use this Web site. Users should be aware that it is technically possible that some of the information collected in this way could be used to reveal your individual identity or location. In the case of AlaskaWriter LLC, the information is only collected in the aggregate for statistical purposes (to get page rankings, for example) and is not used for any direct marketing.
AlaskaWriter LLC values privacy and freedom of speech. Except in the most exceptional of circumstances (ie., as compelled by law in a criminal investigation), AlaskaWriter LLC will never give, sell or transfer personal information to a third party.

MODIFICATION OF THESE TERMS OF USE
AlaskaWriter LLC will make reasonable efforts to notify registered AlaskaWriters Homestead users of any changes or updates to the User Agreement; however, AlaskaWriter LLC reserves the right to make these changes unilaterally, and your continued access to or use of AlaskaWriters Homestead shall constitute your consent to such change.

NO UNLAWFUL/ PROHIBITED USE
Only writers based in Alaska or others specifically authorized and approved by the AlaskaWriter LLC manager/registered agent may obtain and operate an Alaskawriters Homestead site. Pornographic or illegal materials, or those not in keeping with the stated purpose of this site, are not allowed, and any user whose site contains such materials may be terminated without notice at any time. If you have questions about suitability of materials you plan to post on your site, please ask before setting up your account.
As a condition of your use of AlaskaWriters Homestead, you agree that you will not use Alaska Web Writer or AlaskaWriters Homestead for any purpose that is unlawful or contrary to this User Agreement. Alaska Web Writer is licensed for use only on the AlaskaWriters Homestead site.
You also may not use any part of AlaskaWriters Homestead or Alaska Web Writer in any manner that could damage, disable, overburden, or impair the AlaskaWriters Homestead/Alaska Web Writer system or interfere with any other party's use and enjoyment of AlaskaWriters Homestead/Alaska Web Writer. You may not attempt to gain unauthorized access to any Alaska Web Writer account, computer systems or networks associated with Alaska Writers Homestead. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through Alaska Writers Homestead.
Account set-up fees are nonrefundable. In some cases, however, credits for unused portions of annual memberships may be applied to other services, at the discretion of AlaskaWriter LLC.

RIGHT TO TERMINATE/RESTRICT ACCESS
AlaskaWriter LLC reserves the right, in its sole discretion, to terminate membership and/or access to Alaska Writers Homestead via Alaska Web Writer or related services at any time, without notice.
AlaskaWriter LLC may also refuse to issue any Web site or e-mail address request at its discretion.
AlaskaWriter LLC may also terminate or suspend your access to Alaska Writers Homestead for use found not to be in keeping with the intent of the site (ie., Web sites for Alaska writers), at its discretion. Upon termination of your account, your right to use any member portions of AlaskaWriters Homestead or other AlaskaWriter LLC services in existence at the time, including Alaska Web Writer, immediately ceases.

GENERAL
These Terms of Use are governed by the laws of the State of Alaska, USA
AlaskaWriter LLC's performance of this agreement is subject to existing laws and legal process. AlaskaWriter LLC will not be held responsible for any losses incurred as a result of your use or misuse of this site or any services provided here. You agree to indemnify and hold AlaskaWriter LLC harmless from any claim, demand, or damage, including reasonable attorneys' fees, asserted by any third party due to or arising out of your use of or conduct on AlaskaWriters Homestead. If any part of this User Agreement is determined to be invalid or unenforceable pursuant to applicable law, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of this User Agreement shall continue in effect. This User Agreement, including the documents expressly incorporated by reference above, constitute the entire agreement between you and the AlaskaWriter LLC with respect to Alaska Writers Homestead.
